General conditions of sale

These general terms and conditions of sale are applicable to all products or services sold by AmAeGIA. They are applicable in their entirety for any contract entered into between AmAeGIA and its customers in France, regardless of the place of delivery. No derogation from these conditions may be permitted without the written agreement of AmAeGIA. Any condition contrary to these general terms and conditions of sale set by the buyer, in its general terms and conditions of purchase or in any other document, will be unenforceable against the seller, regardless of the amount at which it may have been brought to its attention.

1 - Orders and execution

Any order placed with AmAeGIA is firm and final for the customer upon receipt by AmAeGIA of a purchase order (or any other medium stating the order). The unavailability of a product due to a stock shortage or its removal from the site will not result in any cancellation of the overall order and will not give rise to any compensation from AmAeGIA The products presented on the website https://www.amaegia.com/ are offered for sale for the territories of mainland France.

2 - Prices

Prices are stipulated inclusive of all taxes but excluding transport costs. All duties and taxes currently applicable or which may become applicable will be invoiced in addition.

3 - Payment terms

The prices offered on the site are inclusive of all taxes. By credit card only, you are directed to the secure site of our financial partner. The bank authorization request is encrypted, the principle is identical to that of a classic transaction with a credit card terminal. A confirmation of payment of the order is established by AmAeGIA and sent by email once the amount of the order has been paid.

4 - Withdrawal period

The consumer has a withdrawal period of 7 days from the receipt by the latter. If the consumer exercises his right of withdrawal, undertakes to reimburse the sums paid, free of charge within 15 days of receipt of the returned goods and accompanied by a written request for reimbursement.

5 - Delivery conditions

The delivery times indicated by AmAeGIA are given for information purposes only. No compensation may be granted to the customer in the event of non-compliance with these deadlines, and no order may be cancelled without the express agreement of AmAeGIA.

5-1 - Transport costs

Transport costs are defined in the scale communicated by AmAeGIA on the site and will be payable at the same time as the invoice.

5-2 - Receipt of orders

Any claim will only be valid if it is made within 12 hours of delivery to the customer and by registered mail with acknowledgment of receipt addressed to AmAeGIA. If these elements are not produced, no claim will be accepted. The customer will mention the usual reservations on the delivery note. It will be up to the customer to provide any justification as to the reality of the anomalies noted.

6 - Retention of title

AmAeGIA retains ownership of the dishes sold until actual payment in principal and accessories. The delivery of a title creating an obligation to pay (draft or other) does not constitute payment within the meaning of this clause. Failure to pay any of the due dates may result in the dishes being claimed. The above provisions do not prevent, from the delivery, the transfer to the buyer of the risks of loss or deterioration of the goods as well as any damage they may cause. The Commercial Court of Bordeaux is expressly granted jurisdiction for any dispute between the parties with application of French law.

7 - Information

The customer declares to have read and accepted without reservation the general conditions of sale of AmAeGIA reproduced above. By express agreement between AmAeGIA and the customer, these General Conditions of Sale are governed by and subject to the application of French law.
